7A Tim Calhoun Response to Ashely Forbes

Ashley, I found your paper to be extremely informative on all the legislation that has been implemented into schools regarding special education.  I chose to answer your discussion questions.

1. What are the six principles of IDEA?
Zero Reject, Non Discriminatory Evaluation, Appropriate Education, Least Restrictive Environment, Due Process, and Parental Student Participation.

2. What two purposes does non discriminatory evaluation serve?
Two Purposes that non discriminatory evaluation serve is that they determine if a student has a disability or not and the second is if the disability requires special education to provide the student with the highest quality of education in the least restrictive environment.

3.  Why does the least restrictive environment prove to be one of the most effective forms of inclusion?
The least restrictive environment is one of the most effective forms of inclusion because it allows students with disabilities to place in educational settings with students who are non-disabled.  This allows for students to participate and be apart of general education classrooms.  This is the best practice of inclusion because it allows for the freedom of students with disabilities to move from class to class at their skill level.

4. Name and describe three forms of conflict resolution for parents and school districts. The first type of conflict resolution is informal meeting.  An informal meeting is when teachers and parents sit down to talk about concerns with their children's education. The second type of conflict resolution is Facilitated IEP meeting.  In this scenario teachers and parents sit down and discuss the students progress, however their is a facilitator present to make sure the meeting stays on task and focused on coming to a resolution.  The third conflict resolution is when parents file a complaint with the Department of Education.  The complaint is reviewed by the state officials, and a decision is made on what should be done with the best interest of the child.

5. What do IDEA, Section 504, and ADA have in common? How are they different?
IDEA obligates schools to identify students with disabilities and provide them with a free and appropriate public  education.  Like IDEA section 504 and ADA both require non discriminatory practices when disabled people are applying for public systems.  They differ on what rights they give people with disabilities.  IDEA is based on the education system, whereas Section 504 deals with education but is more of a civil rights law. Finally ADA provides equal opportunity to disabled persons looking for work.
